You don't have anything on the second drive that loads at startup or any system files by any chance??

I used migration assistant when I loaded Leopard would that have copied certain files across?
restart has no effect

try from Terminal:

diskutil list <enter>

then identify the drive, and:

sudo umount /dev/diskX (possibly disk1)
enter your system password (if your the system administrator)

then try erasing in disk utility
